Terms of Service

These Terms of Service ("Terms") govern your use of the ACS Gift Cards Shopify application ("App"). By installing the App you agree to be bound by these Terms.

1. Service description

ACS Gift Cards connects your Shopify store's native gift card functionality to the ACS Interchange financial switch. The App enables issuance, redemption, top-up, and management of gift cards that work across all Shopify store types.

2. Eligibility

You must have a valid Shopify store and an agreement with Altron FinTech / ACS Interchange to use this App. You are responsible for ensuring your use of the App complies with all applicable laws in your jurisdiction, including consumer protection and financial services regulations.

3. Merchant obligations

• You must keep your ACS API credentials secure and rotate them promptly if compromised.
• You are responsible for setting accurate gift card product prices and top-up denominations.
• You must maintain a valid ACS Interchange merchant agreement covering the card programme configured in the App.
• You are responsible for delivering GDPR/POPIA data subject access exports to your customers within the statutory timeframe (30 days for GDPR, 30 days for POPIA).
• You must not use the App to process transactions prohibited under the ACS programme rules or applicable law.

4. Availability and uptime

We strive for high availability but do not guarantee uninterrupted service. Downtime of the ACS Interchange network, Shopify's API, or our hosting infrastructure is outside our control. Gift card issuance and redemption may be temporarily unavailable during maintenance windows or outages.

5. Financial transactions

The App orchestrates financial transactions on your behalf via the ACS Interchange switch. You acknowledge that:

• Transaction approval or decline decisions are made by ACS Interchange, not by the App.
• Failed ACS transactions are logged for reconciliation but do not result in Shopify order cancellations — you must manage exceptions manually.
• The App implements automatic reversals for timed-out ACS calls per the ACS specification; however, settlement finality is governed by your ACS agreement.

6. Data and privacy

Our collection and use of data is described in our Privacy Policy, which forms part of these Terms.

7. Limitation of liability

To the maximum extent permitted by applicable law, the App is provided "as is" without warranty of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to lost revenue, failed gift card transactions, or data loss. Our aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the App, or breach of your ACS Interchange merchant agreement.

9. Changes to the Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Johannesburg, South Africa.
